Contract creation and electronic contracting – The technical steps required to create the contract between you and us are as follows:

You place the order for your products on this website by pressing the place order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on this website. Payment for your order will take place at this point.

We will send to you an order confirmation email detailing the products you have ordered.

Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with the instructions below.

Non-acceptance of an order may be a result of one of the following:

We are unable to obtain authorisation for your payment.

A price or product description error is identified.  

You do not meet the eligibility to order criteria set out in the main Terms and Conditions.

If your order is cancelled in full we will refund you your payment in full, including any associated delivery charges. Should part of your order be cancelled for any reason we will endeavour to send a substitute product of a similar or better nature. Should this not prove to be a satisfactory solution, or that we are unable to provide such a product a refund in full will be offered for that product.

The contract will be concluded in English.

Availability of the Website

Although Millbank Farm aims to offer you the best service possible, we make no promise that our Website services will meet your requirements and we cannot guarantee that the service will be fault free. If a fault occurs in the service, please report it to us (see below for contact details) and we will correct the fault as soon as we reasonably can. Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can. PRIVACY POLICY

Your privacy is very important to us, that’s why we will never release your personal details to any company outside Millbank Farm for mailing or marketing purposes. We will treat all your personal information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep your details on a secure server and we will fully comply with all applicable UK Data Protection and consumer legislation in place.

However, we would like to keep you up to date with a range of products and services provided by Millbank Farm. This includes news of special events, promotions, product launches and catalogues. When ordering online we will automatically sign you up to receive emails from Millbank Farm, you can subsequently unsubscribe should you no longer wish to receive emails.

Please note that you do not have to provide any information to use this website, but if you do choose to shop as a guest user you will not be able to access certain sections or facilities within the site; for example you will not be able to view your order history, nor will you be able to save your personal details. GENERAL INFORMATION AND PAYMENT SECURITY

Delivery / collection restrictions 

Collection for orders placed via millbankfarm.com is available from selected locations. 

We reserve the right to restrict deliveries in certain areas. This includes the right to withdraw our services to individual customers’ addresses if you are repeatedly unavailable to take delivery of your shopping at your chosen slot time or in other exceptional circumstances.

Delivery and collection arrangements 

At the point at which you place your order, the full list of available delivery / collection dates will be shown. 

Delivery will be between 10am-6pm on selected delivery day. Delivery area must be specified within the order process.

Collection days and time can be chosen. Shop collection 1-2pm. Farm Collection 1-5pm. 

Orders left in areas specified by the customer will be left at the owners’ own risks.

General payment provisions – any of the following cards may be used to pay for your shopping: Visa Debit (Delta), Maestro UK, MasterCard, Visa Credit, Solo, American Express.

You are entitled to cancel a payment, or have such sums re-credited to your payment card where fraudulent use of your payment card has been made by another person not acting on your behalf.

Payment Security Policy 


Millbank Farm is a valued, trusted, premium food retailer on the high street and online. We understand your concerns with security and your peace of mind and safety are of the utmost importance to us.

Millbank Farm has secure online ordering facility designed to give you confidence when you use your credit or debit card to shop with us and when you tell us your personal details like your address or phone number.

You may store your card details with us, so that you can order from us again without needing to type your details in.  We only ever show you the last four digits of your card number on our public internet site and of course, this information is ‘for your eyes only’.

If you do not wish to store your card details with us, you can enter these each time you place an order with the Millbank Farm online food shopping service.

Your payment details are held in a secure encrypted server which is not accessible from the Internet. Access to this data is also secured internally within Millbank Farm and all card numbers are encrypted using a highly secure system that financial and banking institutions rely on, called Triple DES (Data Encryption Standard).  This is widely acknowledged as being a very secure way to hide these details from prying eyes.

Once your order is processed, the payment details associated with your order are removed from our files.

Errors/Shortages – Millbank Farm may decline to fulfil any order, including bulk purchase of items on promotion, or included in a special offer.

In the event of there being errors or shortages, these should be brought to the attention of Millbank Farm (using the contact details above) no later than seven days after the delivery, or collection.

Shortages- we go to the market every morning to stock up. So an order placed on a Monday there may be stock short. However, we will have it by the Wednesday for the order. I don’t want orders to fail if there is a shortage in stock on the system. Is there a way that is doesn’t link to the system? 

General Pricing Policy – Prices quoted are always estimated for a variety of reasons listed below, but you will always be charged the in-store price on the day the order is placed. You have the right to return any product with the driver or directly to the branch if you have any issues with price(s) charged and we will refund the amount that you have been charged for that product.

Prices and the availability of special offers may vary for future dated deliveries and collections.

The unit price for products that are weighed and displayed on the site are calculated on drained weight where applicable.

Weighed items such as fruit may vary in weight from that ordered. Customer will always get the quantity ordered/ more than they have ordered.

Where an item is unavailable and you have indicated that you will accept substitutions, an alternative will be supplied that may affect the price that you pay. If we substitute an item with a more expensive one, you’ll only pay the lower of the two prices (if the item we are substituting was of a fixed weight and therefore has a known price). Upon delivery or collection you will be made aware of unavailable items and their substitutes. You have the right to reject any substitutes offered and we will refund the amount that you have been charged for that product. 

The prices stated on the site are inclusive of any VAT payable.

Cancellation rights:

Customer can cancel their order up to 12 noon on the day before the collection/delivery day. If customers aren’t happy with goods, photographic evidence is required to be refunded for the product. 

Please note that your right to return products does not apply to goods made to your specification, that have been clearly personalized/wrapped gift or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.

Notice of such cancellation must be given in writing to Millbank Farm, details as provided above.

Allergens

Millbank Farm’s Staff, Vehicles and packaging may be in contact with nuts, eggs, dairy celery, celeriac, tomatoes, kiwi and most types of fresh raw Fruits & Vegetables.

DELIVERING SHOPPING

Free delivery applies to selected postcodes only. There is a minimum spend on online groceries for delivery – £20 applies.

Charges for the service – Delivery charges apply, and collection is currently free.

Delivery – within 5 miles delivery is free.

10 miles – £3

15 miles –  £5 

We reserve the right to amend our charges and minimum spend requirements, which are clearly defined during the checkout process.

You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. In the event that your delivery is stolen from your doorstep or damaged while there, we do not accept liability, and will offer compensation at our discretion. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal. Any changes to address details must be made before the order deadlines published on our Website.

We endeavour to keep your delivery day the same, but we reserve the right to change it temporarily or permanently and will tell you if we do so.

If we are unable to deliver to you, or have to deliver late, for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss that this causes. We will not, of course, charge for Products unless or until we have delivered them to you

You must inspect the items as soon as possible after delivery and notify us promptly if you find any defects or errors, by calling us or emailing us within 24 hours of delivery Our liability is limited to providing a refund or replacement item at our discretion.

Payment – if you have booked a Millbank Farm order for collection you will be charged at the online check out. If you have booked a delivery and invalid card details have been entered on the checkout page Millbank Farm will contact you to request payment details over the telephone before delivery can be made.

Once an order has been placed we are unable to amend the order, however we can add extra items; in order to do this you must contact Millbank Farm on the above details prior to the order being packed. 

Specific exclusions – some items that are available in branch will not be available on the millbankfarm.com e-commerce site.  Other items may be excluded at various times.

Any refunds for unwanted returned items will be made after the goods have been returned.
